RESUMO:Esta tese analisa a reorganização do espaço fundiário e as dinâmicas de conflito no
mundo rural da Província do Piauí na segunda metade do século XIX, articulando
terra, água e poder como eixos estruturantes da experiência agrária oitocentista.
Inserida no contexto da tentativa de ordenamento territorial promovida pela Lei de
Terras de 1850 e por seu Regulamento de 1854, a pesquisa demonstra que a
ausência de medições e demarcações efetivas das terras devolutas e das posses
particulares produziu um quadro persistente de insegurança jurídica. A sobreposição
de posses, a fragmentação progressiva das propriedades e a permanência de terras
indivisas intensificaram disputas entre posseiros, herdeiros de antigas sesmarias,
trabalhadores livres pobres e autoridades locais, revelando um universo marcado
por fronteiras imprecisas e usos costumeiros do território. Ao analisar
comparativamente os Registros Paroquiais de Terras (1854–1860) e os Registros
Estaduais de Terras (1898–1908), a tese identifica um crescimento expressivo do
número de posseiros sem correspondente ampliação proporcional das datas e
fazendas registradas, evidenciando um processo de fragmentação fundiária que
ampliou tensões locais. Nesse contexto, a água emerge como variável central: em
uma província caracterizada pela irregularidade pluviométrica e pela vulnerabilidade
das “aguadas naturais”, o acesso a cacimbas, poços, açudes e caminhos hídricos
tornava-se condição de permanência na terra. O estudo do conflito em torno da
construção de uma cacimba em terras indivisas na localidade de Paus-Branco
(termo de Marvão), amplamente debatido na imprensa provincial, revela que
disputas aparentemente localizadas expressavam embates mais amplos envolvendo
honra, autoridade, jurisdição e controle de recursos vitais. Metodologicamente, a
pesquisa articula a análise serial de registros fundiários disponíveis no Acervo Digital
do INTERPI com a leitura crítica de processos criminais preservados no Arquivo
Público do Estado do Maranhão, Relatórios de Presidentes da Província do Piauí e
fontes hemerográficas da Hemeroteca Digital da Biblioteca Nacional. Amparada na
História Social, na História do Processo Jurídico e na História Ambiental, a tese
sustenta que os conflitos fundiários não constituíram episódios marginais, mas
elementos estruturantes da organização social e econômica piauiense. Por fim, ao
estabelecer um diálogo com os desafios contemporâneos da regularização fundiária
e da governança da terra no estado do Piauí, demonstra-se que a persistência
histórica da insegurança jurídica, da fragmentação das posses e da centralidade da
água continua a moldar as disputas e as políticas públicas voltadas ao meio rural.
ABSTRACT: This thesis analyzes the reorganization of land tenure and the dynamics of conflict in
the rural world of the Province of Piauí during the second half of the nineteenth
century, articulating land, water, and power as structuring axes of agrarian
experience. Situated within the context of territorial regulation attempts promoted by
the 1850 Land Law and its 1854 Regulation, the study demonstrates that the lack of
effective surveying and demarcation of public and private lands produced a persistent
condition of legal insecurity. The overlap of possessions, the progressive
fragmentation of properties, and the permanence of undivided lands intensified
disputes among smallholders, heirs of former sesmarias, poor free workers, and local
authorities, revealing a social landscape marked by imprecise boundaries and
customary territorial practices. Through a comparative analysis of Parish Land
Registers (1854–1860) and State Land Registers (1898–1908), the thesis identifies a
significant increase in the number of landholders without a proportional expansion in
the number of registered estates, evidencing a process of land fragmentation that
heightened local tensions. Within this framework, water emerges as a central
variable: in a province characterized by irregular rainfall and the vulnerability of
natural water sources, access to wells, reservoirs, dams, and water routes became
essential for remaining on the land. The study of a conflict surrounding the
construction of a well in undivided lands in the locality of Paus-Branco (district of
Marvão), widely debated in provincial newspapers, reveals that seemingly localized
disputes reflected broader struggles involving honor, authority, jurisdiction, and
control over vital resources. Methodologically, the research combines serial analysis
of land records available in the INTERPI Digital Archive with a critical reading of
criminal court records preserved in the Public Archive of the State of Maranhão,
Provincial Presidents’ Reports, and newspaper sources from the National Library’s
Digital Hemeroteca. Grounded in Social History, Legal Process History, and
Environmental History, the thesis argues that land conflicts were not marginal events
but structural components of nineteenth-century Piauí’s social and economic
organization. Finally, by engaging with contemporary challenges of land
regularization and land governance in the state of Piauí, the study demonstrates that
the historical persistence of legal insecurity, land fragmentation, and the centrality of
water continues to shape rural disputes and public policies. |
