SALVAGUARDAS CONSTITUCIONAIS EM SITUAÇÕES DE EXCEPCIONALIDADE: o direito constitucional do trabalho durante a pandemia Covid-19

Abstract

RESUMO:O propósito desta dissertação é analisar as salvaguardas constitucionais em situações de excepcionalidade, notadamente àquelas inerentes ao direito constitucional do trabalho durante a pandemia da Covid-19. Questiona-se: é possível se flexibilizar as salvaguardas constitucionais trabalhistas em “tempos de emergência”? A dinâmica evolutiva do constitucionalismo, a partir do seu amadurecimento e da própria sucessão temporal, leva à conclusão de que a novidade está no movimento. As salvaguardas constitucionais funcionam, pois, como avançado sistema protetivo, a fim de resguardar direitos fundamentais e os primados do Estado constitucional devendo incidir em toda e qualquer circunstância. Elege-se como recorte as Medidas Provisórias nº 927 (perda de eficácia) e nº 936 (convertida em Lei n° 14.020/2020) e a (in)flexibilidade do direito constitucional do trabalho, a partir da posição do Supremo Tribunal Federal tomada em julgamento virtual, quando da análise da medida cautelar na Ação Direta de Inconstitucionalidade n° 6363/DF. ABSTRACT:The purpose of this dissertation is to analyze the constitutional safeguards in exceptional situations, notably those inherent to the constitutional labor law during the Covid-19 pandemic. The question is: it possible to make labor constitutional safeguards more flexible in “times of emergency”? The evolutionary dynamics of constitutionalism from its maturity and from the very temporal succession leads to the conclusion that the novelty is in the movement. Constitutional safeguards work, therefore, as an advanced protective system, in order to safeguard fundamental rights and the primacy of the constitutional state, which must apply in any and all circumstances. Provisional Measures No. 927 (loss of effectiveness) and No. 936 (converted into Law No. 14,020/2020) and the (in) flexibilization of constitutional labor law, from the position of the Federal Supreme Court taken in a virtual judgment, when analyzing the injunction in ADI No. 6363/DF.
