A CENTRALIZAÇÃO DA FEDERAÇÃO BRASILEIRA A PARTIR DAS DECISÕES DO SUPREMO TRIBUNAL FEDERAL NOS CONFLITOS FEDERATIVOS

Abstract

RESUMO: O federalismo é tema recorrente em pesquisas na Ciência Política brasileira, no entanto, o papel do Poder Judiciário como mediador dos conflitos federativos, mesmo relevante, é pouco estudado no Brasil. Embora a repartição constitucional de competências favoreça a expansão do ente central, o federalismo não se esgota nas disposições constitucionais, pois, ao decidir os conflitos federativos, o Supremo Tribunal Federal (STF) acaba revelando as relações de poder que envolvem os entes, especialmente se o arranjo constitucional estimular a apreciação de questões políticas pelo Poder Judiciário. Diante da lacuna que ainda persiste quanto ao tema, a presente pesquisa dedica-se à examinar qual a inclinação do Judiciário, se à centralização ou à descentralização do federalismo brasileiro, ao verificar nas Ações Diretas de Inconstitucionalidade (ADIs) que envolvem conflitos federativos União versus Estado-membro e Estado-membro versus União no período de 1988 a 2016, qual dos entes possui maior chance de vitória na disputa. A fim de cumprir os objetivos deste trabalho, utilizou-se a pesquisa quantitativa e para testar a hipótese de pesquisa o teste bivariado do Qui-quadrado para aferição da associação entre as variáveis em estudo e, posteriormente, para quantificar o resultado das ADIs julgadas, foi realizado o teste Odds Ratio não ajustado. ABSTRACT: Federalism is a recurrent theme in Brazilian Political Science research, however, the role of the Judiciary as mediator of federal conflicts, even relevant, is little studied in Brazil. Although the constitutional division of powers favors the expansion of the central body, federalism is not exhausted in the constitutional provisions, since, in deciding federal conflicts, the Supreme Federal Court (STF) reveals the power relations involving the entities, especially if the constitutional arrangement stimulate the appreciation of political issues by the Judiciary. Faced with the gap that still persists regarding the subject, the present research is dedicated to examining the inclination of the Judiciary, whether to the centralization or the decentralization of Brazilian federalism, when verifying in the Direct Actions of Unconstitutionality (ADIs) that involve federative conflicts Union versus State and State versus Union in the period from 1988 to 2016, which of the entities has the highest chance of victory in the dispute. In order to fulfill the objectives of this study, we used the quantitative research and to test the hypothesis of research the bivariate Chi-square test to gauge the association between the variables under study and, later, to quantify the outcome of the ADIs judged, the Odds Ratio test was not adjusted.
