APROVAÇÃO DE POLÍTICAS PÚBLICAS E O PROCESSO LEGISLATIVO: experiência da lei do PRONATEC no Poder Legislativo

Abstract

RESUMO: O arranjo institucional existente desde a Constituição de 1988 possibilitou ao Executivo uma forma de obter aprovação de suas matérias, utilizando poderes de agenda típicos do presidencialismo de coalizão brasileiro. O poder regimental das lideranças e as comissões internas possibilitam ,dentro do processo legislativo, racionalizar discussões e obter análise especializada das ma térias. Pesquisas existentes informam que é significativo o impacto do Poder Executivo e das lideranças partidárias na aprovação de leis, e que forças individualistas ou paroquialistas são minimizadas desde a nova configuração estabelecida pela Constituição de 1988. O Pronatec é visto como importante política pública para o país devido a seu potencial em transformar condições de produção e da qualidade da inserção de trabalhadores no mercado de trabalho. Sobre o processo de aprovação dessa Lei indaga-se como ocorreu sua aprovação e qual a relação e atuação dos atores envolvidos. Nesta pesquisa, a relação entre os poderes Executivo e Legislativo, bem como o modelo de presidencialismo de coalizão brasileiro são analisados a partir do processo legislativo de aprovação de uma política pública para educação profissional e tecnológica, no caso, o Projeto de Lei que instituiu o PRONATEC no ano de 2011. A proposta é analisar como ocorreu a interação entre esses dois atores na aprovação da política, que mudanças foram realizadas e qual o peso dessas mudanças para o projeto final. ABSTRACT: The institutional arrangement that existed since the 1988 Constitution provided the executive with a way of obtaining approval of his subjects using agenda powers typical of Brazilian coalition presidentialism. The regimental power of leaderships and internal committees make it possible, within the legislative process, to rationalize discussions and obtain specialized analysis of the matters. Research tells us that the impact of executive power and partisan leadership on the passing of laws is significant, and that individualistic or parochialist forces are minimized since the new constitution established by the 1988 Constitution. Pronatec is seen as an important public policy for the country due to its potential in transforming conditions of production and the quality of the insertion of workers in the labor market. Regarding the process of approval of this Law, one inquires how its approval occurred and what the relation and performance of the actors involved. In this research, the relationship between Executive and Legislative, as well as the model of Brazilian coalition presidentialism are analyzed from the legislative process of approval of a public policy for professional and technological education, in this case, the Law Project that instituted Pronatec in 2011. The proposal is to analyze how the interaction between these two actors occurred in the approval of the policy, what changes were made, and the weight of these changes for the final project.
