DESVENDANDO O SENADO DO BRASIL: história, dogmática e dinâmica constitucional do Senado Federal

Abstract

RESUMO:A presente dissertação trata sobre o Senado Federal e a sua multifuncionalidade dentro da separação de poderes do Brasil, investigando especificamente se o órgão é estruturado e funciona de modo a cumprir sua missão constitucional de representação dos estados ou se outros perfis se sobressaem no seu desenho institucional e na sua dinâmica de funcionamento. A hipótese que orienta o trabalho é a que o Senado do Brasil não tem como ênfase, nem na forma como o texto da Constituição de 1988 pensou o órgão e nem no seu funcionamento, o perfil federativo, ganhando destaque outros perfis que podem ser pensados e explorados na separação e equilíbrio entre os poderes da República. A dissertação foi desenvolvido por meio de pesquisas descritivas e comparativas; foi feito uso dos procedimentos técnicos de pesquisa bibliográfica e documental. De maneira específica, o primeiro capítulo fez uma análise doutrinária, histórica e comparativa entre modelos e experiências de câmaras altas do Ocidente; o segundo capítulo desenvolveu uma investigação histórico-constitucional do órgão no Brasil; o terceiro foi dedicado a um estudo de dogmática constitucional sobre o instituto e o último analisou a dinâmica do Senado brasileiro pós-1988. ABSTRACT:This dissertation is about the Federal Senate and its multifunctionality in the separation of powers in Brazil, specifically investigating if the body is structured and functions in such a way as to fulfill its constitutional mission of representing the states or if other profiles stand out in its institutional design and in its operating dynamics. The hypothesis that guides the work is that the Brazilian Senate has no emphasis, neither on the way the text of the 1988 Constitution thought of the body nor on its functioning, the federative profile, highlighting other profiles that can be thought of and explored in the separation and balance between the powers of the republic. The dissertation was developed through descriptive and comparative research; technical procedures of bibliographic and documentary research were used. Specifically, the first chapter made a doctrinal, historical and comparative analysis between models and experiences from the upper chambers of the West; the second chapter developed a historical-constitutional investigation of the body in Brazil; the third was devoted to the third was devoted to a study of constitutional dogmatics about the institute and the last analyzed the dynamics of the post-1988 Brazilian senate.
