ANTÔNIO COELHO RODRIGUES NA TRANSIÇÃO ENTRE A MONARQUIA E A REPÚBLICA: Movimentações políticas e jurídicas de um sujeito histórico contraditório

Abstract

RESUMO O presente trabalho desenvolveu estudo sobre Antônio Coelho Rodrigues, político e jurisconsulto brasileiro, que viveu de 1846 a 1912. Coelho Rodrigues foi um dos p rincipais representantes políticos do Piauí como deputado e senador, tanto no Império como na República brasileira. Sua representatividade no cenário nacional da política e a afamada carreira como professor de direito, sobretudo direito civil, proporcionaram ao mesmo, quando instalado o novo regime, que fosse contratado para a redação do primeiro projeto de código civil da República, no ano de 1890. O problema da nossa pesquisa gira em torno de um suposto silenciamento e relativo esquecimento histórico de Coelho Rodrigues, o qual abre a possibilidade de discussão historiográfica, como sujeito signo da pesquisa, pela ampliação do conhecimento sobre as disputas políticas nacionais, e como no período de transformações pelas quais passava a sociedade brasileira, Coelho Rodrigues vai ser importante, sobretudo enquanto intelectual na condução de um trabalho de época reclamado pelo tempo, o código civil, onde a renovação do aparato legislativo de direito privado tornava-se necessidade urgente como elemento material e simbólico fundamental para a construção da nação que se pretendia criar. Suas movimentações políticas e jurídicas favorecem um pouco a compreensão quanto à transição da Monarquia a República, e nesse meio revelam as contradições de um tempo que empurraram Coelho Rodrigues à condição de fracassado dentro do seu espaço de atuação e, consequentemente, na historiografia.

ABSTRACT The present work developed a study on Antônio Coelho Rodrigues, a Brazilian politician and jurisconsult, who lived from 1846 to 1912. Coelho Rodrigues was one of the main political representatives of Piauí as a deputy and senator, both in the Empire and in the Brazilian Republic. His representation on the national political scene and his famous career as a professor of law, especially civil law, allowed him, when the new regime was installed, to be hired to write the first draft of the civil code of the Republic, in 1890. The problem of our research revolves around a supposed silencing and relative historical oblivion of Coelho Rodrigues, which opens the possibility of historiographical discussion, as a sign subject of research, for the expansion of knowledge about national political disputes, and how in the period of transformations that Brazilian society was going through, Coelho Rodrigues will be important, especially as an intellectual in conducting a work of the time demanded by time, the civil code, where the renewal of the legislative appar atus of private law became an urgent need as a material and fundamental symbol for the construction of the nation that was intended to be created. His political and legal movements somewhat favor the understanding of the transition from Monarchy to Republic, and in this environment they reveal the contradictions of a time that pushed Coelho Rodrigues to the condition of failure within his space of action and, consequently, in historiography.
