A JUDICIALIZAÇÃO DO DIREITO À SAÚDE: a obtenção de medicamentos por via judicial junto à Secretaria Municipal de Saúde de Parnaíba, Piauí

Abstract

RESUMO Esta pesquisa visou analisar a judicialização do direito à saúde no Município de Parnaíba, Estado do Piauí, tomando como referência as ações judiciais que tinham como causa de pedir a obtenção de medicamentos e será desenvolvido junto à Secretaria Municipal de Saúde de Parnaíba onde serão analisados os processos judiciais distribuídos entres os anos de 2017 a 2020 que tramitam na 4ª Vara Cível da Comarca de Parnaíba. O objetivo é, portanto, evidenciar o Direito à Saúde, previsto expressamente na Constituição Federal de 1988, analisando a garantia e a seguridade desse direito por meio de decisões judiciais, a fim de obter medicamentos junto à Secretaria Municipal de Saúde de Parnaíba, analisando atuação dessa secretaria no intuito de diminuir ou sanar as ações judiciais que apresentam essa causa de pedir. A pesquisa terá ainda como complemento a análise que os impactos financeiros causados pelas demandas judiciais que tutelam a obtenção de medicamentos causam aos cofres públicos do município de Parnaíba, além de delinear o perfil dos sujeitos envolvidos nesse tipo de demanda. A problemática abordada na pesquisa é crescente, para isso utilizou-se o método qualitativo para analisar e interpretar os dados colhidos relativos ao tema. Para a coleta de dados foram aplicadas pesquisas: exploratória e descritiva em dados primários além da pesquisa bibliográfica, documental e de campo. Foi efetivada uma revisão de literatura de obras e artigos científicos que tratam sobre a Judicialização da Saúde, bem como estudo da legislação constitucional e infraconstitucional que abordam o tema. Dessa forma, tem-se como proposta central a avaliação e o levantamento da atuação da Secretaria Municipal de Saúde de Parnaíba, Piauí, frente à concessão de medicamentos por meio de determinações judiciais.

ABSTRACT The present study aimed to analyze the judicialization of the right to health in the Municipality of Parnaíba, State of Piauí, taking as a reference the lawsuits that had the cause of requesting the obtaining of medicines and will be developed together with the Municipal Health Department of Parnaíba where they will be analyzed the lawsuits distributed between the years 2017 to 2020 that are being processed at the 4th Civil Court of the Parnaíba District. The objective is, therefore, to highlight the Right to Health, expressly provided for in the Federal Constitution of 1988, analyzing the guarantee and security of this right through judicial decisions, in order to obtain medicines from the Municipal Health Department of Parnaíba, analyzing performance of this secretariat in order to reduce or remedy the lawsuits that present this cause to request. The research will also complement the analysis that the financial impacts caused by the judicial demands that protect the obtaining of medicines cause to the public coffers of the municipality of Parnaíba, in addition to delineating the profile of the subjects involved in this type of demand. The problem addressed in the research is growing, therefore, we will approach the qualitative method to analyze and interpret the data collected related to the theme. For data collection, research will be applied: exploratory and descriptive in primary data related to a bibliographic, documentary and field research. In addition to the literature review of works and scientific articles that deal with the Judicialization of Health, as well as the study of constitutional and infra-constitutional legislation that address the theme. Thus, the central proposal is the evaluation and survey of the performance of the Municipal Health Department of Parnaíba, Piauí, in relation to the granting of medicines through judicial determinations.
