Abstract:
RESUMO: Discute-se, nesta dissertação, o problema que a emissão de enunciados gerais e abstratos por
tribunais superiores no Brasil suscita em face do princípio da separação de poderes, a saber: quais são
as características de um precedente vinculante. Para tanto, resgata-se a distinção entre direito (nomos)
e legislação (thesis), tal como proposta por Hayek. Ressalta-se que o pensamento político-filosófico
moderno, caracterizado pelo racionalismo construtivista, a partir do iluminismo, pretendeu reduzir
toda a complexidade do fenômeno jurídico à vontade da potestade estatal, instaurando o paradigma
da lex. Assim, sustenta-se que a definição de teses por órgãos jurisdicionais de cúpula não pode ser
convertida em método de legislação judiciária, pelo qual se busque a imposição arbitrária de
programas políticos, sem o indispensável lastro democrático, escapando aos mecanismos de controle
do poder, proporcionados pelo governo representativo, para usurpar as funções legislativa e
executiva, as quais somente podem ser exercidas, como regra, por representantes eleitos do povo.
ABSTRACT: This dissertation discusses the problem that the issuance of general and abstract
announcements by higher courts in Brazil raises in view of the principle of separation of powers,
namely: what are the characteristics of a binding precedent. To this end, the distinction between law
(nomos) and legislation (thesis) was rescued, as proposed by Hayek. It should be noted that the
modern political-philosophical thought, characterized by constructivist rationalism, from the
Enlightenment, intended to reduce all the complexity of the legal phenomenon to the will of state
power, establishing the paradigm of lex. Thus, it is argued that the definition of theses by the highest
jurisdictional bodies cannot be converted into a method of judicial legislation, by which the arbitrary
imposition of political programs is sought, without the indispensable democratic ballast, escaping the
control switches of power, provided by representative government, to usurp legislative and executive
offices, which can only be exercised, as a rule, by elected representatives of the people.
