A SAÚDE PÚBLICA EM JUÍZO: uma análise sobre o fornecimento de medicamentos gratuitos no Piauí

Abstract

RESUMO: O presente trabalho tem como foco de investigação a judicialização do fornecimento de medicamentos no estado do Piauí. Para tanto, pretende-se estudar os argumentos utilizados pelos atores envolvidos nas demandas judiciais relativas à matéria em tramitação no Tribunal de Justiça do Piauí. Serão analisadas decisões, bem como petições fornecidas pelos órgãos participantes da demanda judicial que envolvam a temática. Os órgãos em análise são: Vara dos Feitos da Fazenda Pública, Defensoria Pública, Ministério Público e Procuradoria do Estado. Tem-se por objetivo principal o mapeamento de padrões de respostas utilizados por esses órgãos. Embasa teoricamente a análise dos dados desta pesquisa o argumento de Stephen Holmes e Cass R. Sustein em The cost of rights: why liberty depends on taxes?, com o intuito de realizar um paralelo entre a ideia central do livro, de que todos os direitos possuem um custo, e o dispêndio realizado pelo estado do Piauí no tocante ao cumprimento das decisões judiciais que determinam o fornecimento gratuito de medicamentos.

ABSTRACT: The present study focuses on the judicialization of the supply of medicines in the state of Piauí. Therefore, it is intended to study the arguments used by the actors involved in the lawsuits related to the matter in the State Court of Justice. It will analyze decisions, as well as petitions provided by the bodies involved in the lawsuit involving the issue. The organs in analysis will be: Court of the Made of the Public Treasury, Public Defender, Public Ministry and Attorney of the State of Piauí. The objective is to map the response patterns used by these organs. Secondly, a study will be done on the book The cost of rights: why liberty depends on taxes? In order to parallel the main idea of the book that all rights have a cost, and the state of Piauí regarding compliance with the judicial decisions that determine the free supply of medicines by the state.
