COMPLIANCE PÚBLICO: um estudo de caso sobre a política de integridade da Anatel.

Abstract

RESUMO: A proposta central desta dissertação é analisar a implementação da política pública de integridade do governo federal para prevenção e combate à corrupção, entre o período de 2016 a 2020. Dentre outros objetivos, estão averiguar como se deu a mudança institucional que possibilitou a emergência da política pública de integridade, bem como identificar os mecanismos que contribuíram para a inserção do tema da integridade pública na agenda governamental, investigando a trajetória dos atores e das instituições envolvidas dentro do contexto. Com isso, espera-se contribuir com o incipiente aporte teórico sobre o tema na área da Ciência Política, visto que, a política pública foi implementada recentemente no âmbito do governo federal. Para tanto, frente ao caráter descritivo da pesquisa, optou-se por adotar um enfoque metodológico qualitativo a partir de um estudo de caso com a Agência Nacional de Telecomunicações (ANATEL). Dessa forma, este trabalho se beneficiou para a coleta de dados das técnicas de análise documental (relatórios, planos e legislação) e entrevistas, bem como para a análise de dados foram utilizadas as técnicas análise de conteúdo e de process-tracing. A técnica de process-tracing visa um mapeamento de cadeias causais que ligam determinados fenômenos a determinados resultados. Assim, a partir desta análise foi possível verificar que o processo de implementação da política pública de integridade no governo federal entre o período de 2016 a 2020, foi promovido por mecanismos causais como a pressão internacional, o tensionamento institucional e a articulação da Controladoria Geral da União (CGU), configurando uma trajetória de mudança institucional em deslocamento e em camadas. Quanto à aderência a implementação do programa de integridade na Anatel, se apresenta em três dimensões: 1) Institucional; 2) Individual (comportamental); e 3) Cultural. Apesar do alto nível de maturidade institucional, o órgão regulador ainda apresenta algumas falhas a serem melhoradas e desafios a serem superados. No entanto, em virtude da implementação recente da política pública de integridade no âmbito estatal, as condições de efetividade das medidas e a sua real capacidade para prevenir e combater à corrupção somente poderá ser mensurada ao longo do tempo. ABSTRACT: The main purpose of this dissertation is to analyze the implementation of the public integrity policy by the federal government for preventing and combating corruption, between the period 2016 to 2020. Among other objectives, the intention is to find out how the institutional change took place and enabled the emergence of the public integrity policy, as well as identify the mechanisms that contributed to the insertion of the theme of public integrity in the governmental agenda, investigating the trajectory of the actors and institutions involved within the context. Therefore, it is expected to contribute with the incipient theoretical contribution on the subject in the area of Political Science, since the public policy was recently implemented within the scope of the federal government. Moreover, given the descriptive character of the research, it was decided to adopt a qualitative methodological approach based on a case study with the National Telecommunications Agency (ANATEL). Furthermore, this paper benefited from the collection of data from document analysis techniques (reports, plans and legislation) and interviews, as well as for data analysis, content analysis and process-tracing techniques were used. The process-tracing technique aims at mapping causal chains that link certain phenomena to certain results. Thus, from this analysis, it was possible to verify that the process of implementing the public integrity policy in the federal government, between the period 2016 to 2020, was promoted by causal mechanisms such as international pressure, institutional tension and the articulation of the General Comptroller’s office (CGU), configuring a trajectory of institutional change in displacement and in layers. As for adherence to the implementation of the integrity program at Anatel, it is presented in three dimensions: 1) Institutional; 2) Individual (behavioral); and 3) Cultural. Despite the high level of institutional maturity, the regulatory body still has some flaws to be improved and challenges to be overcome. However, due to the recent implementation of the public integrity policy at a state level, the conditions for the effectiveness of the measures and their real capacity to prevent and fight corruption can only be measured over time.
