“PARA BEM CUMPRIR” A LEI DAS TERRAS: O processo de regularização fundiária no centro-sul da Província do Piauí (1850-1860)

Abstract

RESUMO A dissertação objetiva analisar como se deu o processo de regularização fundiária no centro-sul da Província do Piauí entre os anos de 1850 e 1860, conforme pretendia a Lei Imperial nº 601/1850, popularmente conhecida como Lei de Terras. Apresentamos, mediante debate historiográfico e jurídico, a Lei de Terras, o regulamento nº 1318 de 1854 e o processo de ocupação das terras onde hoje se constitui o Piauí. Analisamos a atuação do Estado Imperial para a institucionalização de sua política de terras através da Repartição Geral de Terras Públicas e no diálogo com a Província do Piauí para execução do registro de terras possuídas e por meio da criação de uma Repartição Especial das Terras Públicas em Teresina, sendo esta responsável, em âmbito local, por encaminhar esta política. Por fim, debruçamo-nos sobre os Registros Paroquiais de Terras produzidos pelo Padre José Dias de Freitas na Freguesia de Nossa Senhora dos Remédios dos Picos, procurando observar o trabalho de registro de posses, a sua distribuição pelas fazendas da freguesia e seus posseiros. Durante o trabalho de pesquisa pudemos escrutinar, além de uma vasta produção acadêmica sobre o tema, os relatórios dos Presidentes da Província do Piauí, os relatórios e avisos circulares da Repartição Geral de Terras Públicas, as comunicações da Repartição Especial de Terras Públicas em Teresina e o Registro Paroquial de Terras da Freguesia de Nossa Senhora dos Remédios dos Picos. ABSTRACT The dissertation aims to analyze how the process of land regularization took place in the center-south of the Province of Piauí between the years 1850 and 1860, according to Imperial Law number 601/1850, popularly known as Land Law. We present, through historiographic and legal debate, the Land Law, regulation number 1318 of the year 1854 and the process of occupation of the lands where Piauí is now constituted. We analyze the performance of the Imperial State in the institutionalization of its land policy through the General office of Public Lands and in the dialogue with the Province of Piauí in executing the registry of owned lands and through the creation of a Special Office of Public Lands in Teresina, which is responsible for directing this policy at the local level. Finally, we look at the Parish Land Records produced by Father José Dias de Freitas in the Parish of Nossa Senhora dos Remédios dos Picos, seeking to observe the registering of possessions, their distribution among the parish farms and their squatters. During the research we were able to scrutinize, in addition to a large academic production on the subject, the reports of the Presidents of the Province of Piauí, the circular reports and announcements of the General Office of Public Lands, the communications of the Special Public Lands Office in Teresina and the Parish Register of Lands of the Parish of Nossa Senhora dos Remédios dos Picos.
