A MODALIDADE NOS DEPOIMENTOS DE RÉUS EM AUDIÊNCIA CRIMINAL: Um estudo sob a perspectiva da Teoria das Operações Predicativas e Enunciativas

Abstract

RESUMO: A presente pesquisa pretende analisar como a modalidade linguística é manifestada por meio das marcas enunciativas observáveis no interior dos enunciados que compõem o depoimento do réu em audiência criminal, verificando as operações envolvidas no processo de construção/reconstrução do sentido de defesa. Para tanto, foi necessário realizar a identificação das ocorrências das marcas representativas de valores modais construídos no interior dos enunciados analisados, as quais permitem o acesso às operações enunciativas subjacentes, relacionadas ao funcionamento da modalidade linguística. Esta investigação esteve fundamentada no âmbito da Teoria das Operações Predicativas e Enunciativas – TOPE, buscando subsídios teóricos em Culioli (1968, 1971, 1983, 1990, 1991, 1995, 1999, 2002), em Campos (1989, 1997, 1998, 2004), e Neves (2006, 2012), dentre outros. Para o desenvolvimento da pesquisa, foram utilizados enunciados provenientes de 4 depoimentos de 4 réus em situação de audiência de instrução criminal, os quais constituíram o corpus de análise do estudo. Durante as análises, verificou-se que, para o estabelecimento da defesa do réu, a manifestação do valor de negação se fez preponderante no decorrer da construção de sentido dos enunciados, observando-se a manifestação de valores de negação fundados na utilização da marca de negação “não”, na ocorrência de marcas temporais de valor negativo, além da ocorrência de valores modais epistêmicos e apreciativos. Esperase, com a presente pesquisa, contribuir com o cenário dos estudos no âmbito da TOPE, apresentando uma perspectiva sobre o funcionamento da negação no decorrer de uma situação enunciativa que coincide com a situação de defesa do réu em processo criminal. ABSTRACT: This research intends to analyze how the linguistic modality is manifested through enunciate marks observed into statements that compose defendant’s testimony in criminal hearing, verifying the operations involved in the process to the meaning construction/reconstruction during the criminal defense. Therefore, it was necessary to make the occurrence identification of representative marks of modal values built inside the statements analyzed, which permitted the access to underlying enunciate operations related to the linguistic modality functioning. This investigation was supported by the Theory of Predicative and enunciate operations – TOPE, searching for theoretical background in Culioli (1968, 1971, 1983, 1990, 1991, 1995, 1999, 2002), in Campos (1989, 1997, 1998, 2004), and Neves (2006, 2012), among others. To develop this research, statements from four testimonies from four defendants in criminal instruction audience situation were used, which constituted this study’s analysis corpus. The analysis consisted on the verification of the manifestation of negation values predominant during the statement’s meaning construction supported in the use of the negation mark “no”, in the occurrence of time marks of negation values, besides the occurrence of epistemic and appreciative modal values occurrence to establish the defendant’s defense. This research expects to contribute with the study scenario of TOPE by presenting a perspective about functioning of negation during the enunciate situation that coincides with the defendant’s defense situation in criminal processing.
