A ACCOUNTABILITY NO MINISTÉRIO PÚBLICO: da atuação demandista à atuação resolutiva

Abstract

RESUMO: A presente dissertação enfoca o Ministério Público brasileiro a partir de uma perspectiva de sua reforma. Para apontar a necessidade de que o Ministério Público se democratize e seja submetido a mecanismos de accountability, o trabalho faz uma primeira incursão em torno do tema da teoria democrática e do conceito de accountability. Depois, se dedica à teoria do Ministério Público, e faz uma descrição de como o Ministério Público foi erigido. Por fim, discute a Reforma do Judiciário de 2004, e trata da criação do Conselho Nacional do Ministério Público, órgão que, na perspectiva da dissertação, pode ser portador dos instrumentos de democratização que hoje fazem falta ao Ministério Público. ABSTRACT: The present thesis focus on the Brazilian “Ministério Público” (Attorney General) from the perspective of its recent reforms. To point out the necessity of democratization of the “Ministério Público”, and its submission to mechanisms of accountability, our work first carries an incursion on the theme of democratic theory and the concept ofaccountability. Then, we dedicate to the theory of the “Ministério Público”, describing on the construction and modifications of the “Ministério Público”. At last, we discuss the 2004 Judicial Power Reform, and discuss the creation of the “Conselho Nacional do Ministério Público” (National Council of the Attorney General), an institution which, from this thesis perspective, might be the bearer of the democratizing instruments which to date are missing in the Brazilian “Ministério Público”.
