A PROTEÇÃO SOCIAL PRODUZIDA PELA FAMÍLIA AOS ADOLESCENTES EM SITUAÇÃO DE CONFLITO COM A LEI: limites e possibilidades

Abstract

RESUMO:O objeto de investigação desta tese é a família e a garantia da proteção social aos seus membros. O objetivo geral foi analisar a proteção social desenvolvida pela família dos adolescentes em situação de conflito com a lei no município de Chapadinha/MA. Para atingir tal propósito os objetivos específicos foram: Conhecer a história social da família no mundo ocidental; Identificar as ações Estatais de proteção social dos adolescentes em situação de conflito com a lei na realidade brasileira e, identificar a proteção social produzida pelas famílias na cidade de Chapadinha/MA. Para aprofundamento analítico, realizou-se estudo bibliográfico e documental por meio do qual foi possível analisar as produções no tocante ao estado da arte da família enquanto grupo promotor da proteção social de seus membros, a pesquisa de campo também foi uma estratégia de investigação social. Foram entrevistados oito grupos familiares com vistas a conhecer a realidade social das famílias com adolescentes em situação de conflito com a lei no município de Chapadinha- MA. Os dados foram construídos a partir de entrevistas semiestruturadas analisadas à luz do referencial teórico e documental, com base no método dialético de Marx (1989). Foi possível concluir que a família continua sendo um ator fundamental na produção de proteção social dos seus membros, apesar das vulnerabilidades que caracterizam o seu contexto de vida e que comprometem a qualidade da proteção social que podem ofertar. Quanto à atuação do Estado, na perspectiva legal, verificaram-se avanços com a instalação da doutrina da proteção integral em substituição a doutrina menorista, bem como com a centralidade da família nas políticas sociais, entretanto, no aspecto prático, as famílias pesquisadas vivenciam uma realidade de insuficiência das políticas públicas para o provimento da proteção social dos adolescentes em situação de conflito com a lei, e de limitações para o compartilhamento das responsabilidades da proteção social dos seus membros. No cenário jurídico verificou-se a permanência de influências da doutrina menorista (que reforçam o discurso culpabilizador da família) e a existência de dificuldades de aplicação da doutrina da proteção integral no empoderamento destas famílias. ABSTRACT:The object of investigation of this thesis is the family and the offer of social protection to its members. The general objective was to analyze the social protection developed by the family of adolescents in conflict with the law in the municipality of Chapadinha / MA. To achieve this purpose the specific objectives were: To know the social history of the family in the Western world; To identify the State social protection actions of adolescents in conflict with the law in the Brazilian reality and to identify the social protection produced by the families in the city of Chapadinha / MA. For analytical deepening, a bibliographic and documentary study was carried out through which it was possible to analyze the productions regarding the state of the art of the family as a group promoting the social protection of its members. Field research was also a social research strategy. Eight family groups were interviewed in order to know the social reality of families with adolescents in conflict with the law in the municipality of Chapadinha- MA. The data were constructed from semistructured interviews analyzed in the light of the theoretical and documentary referential, based on the dialectical method of Marx (1989). It was possible to conclude that the family continues to be a fundamental actor in the production of social protection of its members, despite the vulnerabilities that characterize their life context and which compromise the quality of the social protection they can offer. As for the state's performance, from the legal point of view, progress has been made with the installation of the doctrine of integral protection, replacing the doctrine of the minority, as well as with the centrality of the family in social policies; however, in the practical aspect, the families surveyed experience a reality of insufficient public policies to provide social protection for adolescents in conflict with the law, and limitations on the sharing of the responsibilities of social protection of their members. In the legal scenario, the influence of minorist doctrine (which reinforces the family's guilty discourse) and the existence of difficulties in applying the doctrine of integral protection in the empowerment of these families were verified.
